Terms of Sale

1. Purpose and service definition

Hexatenberg provides a hybrid solution of software and services. The offer includes:

• Software: A library of blocks for the WordPress Gutenberg editor.
• SaaS service: Access to the update API, the online catalog, the license management studio, and technical support.

Purchasing a license grants access to the Service for a defined period.

2. License and intellectual property (GPL specific)

2.1. Blocks (Software): All WordPress blocks distributed by Hexatenberg are derivative works of WordPress. As such, they are released under the GNU General Public License (GPL) version 2 or later. The Client is free to use, modify, and redistribute the source code under the GPL terms.

2.2. Commercial service: Unlike the GPL code, the license key, access to automatic updates, technical support, and the SaaS interface constitute a proprietary commercial service. This service is strictly personal and non-transferable. The Seller reserves the right to suspend access to the Service (API and updates) if the license key is publicly shared or abused, without affecting the Client's rights to previously downloaded GPL code.

2.3. Trademark: The name "Hexatenberg", the logo, and the site's visual identity are protected by copyright and are not covered by the GPL license.

3. Pricing

Prices are shown in euros (EUR) excluding taxes or including taxes depending on the Client's tax residency. EI Olivier Roy Webdesign reserves the right to change prices at any time. Subscription renewals will be billed at the rate in effect at the time of renewal.

4. Orders and payment

Payment is due immediately upon order. Payment is made by credit card via the secure Stripe provider. By subscribing to a recurring offer, the Client agrees that the payment method will be automatically charged at each due date (annual or monthly) until cancellation.

5. Delivery and access

Delivery is digital and immediate. Once payment is validated, the Client receives their license key and access to their dashboard.

6. Waiver of withdrawal right

Hexatenberg products are digital content not provided on a physical medium, and performance begins immediately after payment (download access and API key). The Client therefore cannot exercise the withdrawal right.

However, a 14-day "Satisfaction or Refund" guarantee may be granted on a commercial basis if the software is technically unusable on the Client's installation after unsuccessful support intervention.

7. Term, renewal, and cancellation

7.1. Renewal: Subscriptions renew automatically for successive periods of the same duration.

7.2. Cancellation: The Client can cancel the subscription at any time from their customer area ("My Account"). Cancellation stops future charges but does not entitle the Client to any pro-rata refund.

7.3. Effects of cancellation: Upon expiration:

• The Client retains the right to use the blocks already installed on their sites (under the GPL).
• The Client loses access to technical support.
• The Client loses access to security and feature updates.
• The Client can no longer download new blocks from the catalog.

8. Liability and warranty

Products are provided "as is". EI Olivier Roy Webdesign does not guarantee compatibility with all third-party plugins or themes. The Client must verify technical compatibility (PHP versions, WordPress versions) indicated on the site. EI Olivier Roy Webdesign's liability cannot be engaged for indirect damages (loss of data, loss of business) and is, in any event, limited to the amount paid by the Client over the last 12 months.

9. Personal data

The data collected is necessary to manage the commercial relationship. In accordance with the GDPR, the Client has the right to access, rectify, and delete their data. See our Privacy Policy.

10. Applicable law and jurisdiction

These Terms are governed by French law. Any dispute regarding their interpretation or execution falls under the exclusive jurisdiction of the courts of Angers, notwithstanding multiple defendants or third-party claims.
